Advanced Embroidery Designs ("Advanced Embroidery", "we" or "us") owns the complete rights to all of the artwork and embroidery designs available for sale or for free download from www.advanced-embroidery-designs.com ("Designs" or "Design").

By downloading or purchasing any of our Designs, you agree to be bound by the terms of this Licensing Agreement:

License to Use Our Designs

When you download and/or purchase a Design from us, the Design remains the intellectual property of Advanced Embroidery. You are purchasing a limited lifetime license to embroider the Design in an embroidery machine. The license is non-transferable, meaning that only you, the original purchaser, can use the design.

Permitted Uses:

Permitted uses of our designs are limited to:

• Embroidery on personal items;
• Embroidery on items for limited commercial use, including sale at craft shows and craft fairs, in-person sales, sales via social media and/or through personal websites;
• Embroidery on items for charity;
• Embroidery on items to give as gifts.

You are permitted to edit the Design in any manner. However, Advanced Embroidery retains all rights and full ownership of the modified Design file. The edited file is subject to the same restrictions as the original Design from which it was made.

If you are a business or organization, you must purchase one of the Design for each person who uses the Design.

Commercial, Wholesale or Mass Retail Use:

If you are interested in using our Designs for wholesale or mass retail sale purposes, such use is NOT covered by this Licensing Agreement. Contact Us to discuss licensing.

Prohibited Uses:

We prohibit uses of our Designs, photographs, or other images, except those specifically permitted within this Licensing Agreement.

Prohibited uses include, but are not limited to:

• Selling, sharing, gifting, transferring, distributing, bequeathing or re-selling in any manner the Design files; if a coworker, friend or family member is interested in our Designs, please direct them to our website;
• Using our Designs for any purpose other than machine embroidery; this includes but is not limited to:
  • to create vector files for machining processes;
  • to embroider by hand;
  • as a template for screen or sublimation printing;
  • as part of a company logo or other logo;
  • as a template for etching;
• Using our photographs, other images, text or any other information available on our website for any purpose, including on your own website or promotional materials. If you are selling a product embroidered with our Design, you must take your own photograph of this item;
• Using our Designs on a shared embroidery machine, "machine for hire" or in any other place where other people could access our Designs;
• Using our Designs as a basis for creating your own embroidery designs, templates or other derivative work;
• Using our Designs for wholesale or mass retail sale;
• Licensing products which you created using our Designs for wholesale or mass retail sale;
• Implying or claiming that you are the author of the Design or any artwork used in the Design.

Termination:

If we become aware that you are in violation of the terms of this Licensing Agreement, we reserve the right to terminate your license immediately and to pursue restitution for damages through legal means.
